NOVO ESTATUTO JURÍDICO DOS ANIMAIS EM PORTUGAL: DIREITO CIVIL E EXPERIMENTAÇÃO ANIMAL | New legal status of animals in Portugal: civil law and research with animals

RESUMO: As recentes alterações introduzidas em Portugal, no plano civil e penal, pela aprovação do Novo Estatuto Jurídico dos Animais - Lei n.º 8/2017, de 3 de março - seguem uma tendência de alargamento da tutela. A alteração que aqui convoca a nossa reflexão está prevista no artigo 493.º-A - Indemnização em caso de lesão ou morte de animal -, em particular o n.º 3 do artigo, onde é questionável se o legislador foi mais além na tutela da relação com o animal, do que face àquelas a que subjaz uma relação familiar - de filiação, conjugalidade ou união de facto (cf. artigo 496.º do Código Civil). Muito embora o caminho seja no sentido do alargamento, o direito dos animais é um tema complexo, não só por implicar opções fundamentais quanto à arquitetura dos sistemas jurídicos, mas, também, porque é perpassado por relevantes discussões bioéticas, v.g., no âmbito da experimentação animal, designadamente os problemas de comissões de ética para a investigação animal e os métodos alternativos, aqui analisados.

ABSTRACT: The recent changes introduced in Portugal, in civil and criminal law, by the approval of the New Legal Status of Animals - Law no. 8/2017, 3 March - follow a trend towards increasing legal protection. The introduction of Article 493.º-A in Civil Code (Compensation in case of injury or death of animal), in particular no. 3, is the focus of our concern and we may wonder if the legislator has gone further in the protection of a relationship with an animal than in the case of a family relationship (see Article 496 of the Portuguese Civil Code). Although the path is towards enlargement, animal law is a complex subject, not only because it involves fundamental options as to the architecture of legal systems, but also because it is permeated by relevant bioethical discussions, e.g., in the field of animal experiment, namely the problems of ethics committees and alternative methods, issues that are discussed in this paper.
